Does a US LLC Pay Tax If It Has No US Income?

A US LLC with no US-source income and no US presence generally owes no US federal income tax — but it still has to file. Owing nothing and filing nothing are different things, and the gap between them is where the $25,000 penalties live.

Why there is usually no tax

A single-member LLC owned by a non-resident is a disregarded entity by default: it is not taxed as a separate person, and the income is treated as its owner’s. A non-resident owner is taxed by the US only on income that is US-source or effectively connected with a US trade or business.

So a consultancy run from another country, delivering remotely, with no US office, staff or dependent agent, typically has neither — even where every client is American. Having US customers is not the same as having a US business.

No US tax is not no tax. The profit is generally taxable where you are resident, and forming a US LLC does not change that. Any advice that treats a US LLC as tax-free full stop is describing half of a picture and leaving you with the other half.
